Trump lawyers request New York verdict be set aside, sentencing delayed following Supreme Court ruling

by | Jul 1, 2024

President Trump's legal team requested on Monday that New York Judge Juan M. Merchan set aside Trump's conviction and delay his upcoming sentencing. This request follows the U.S. Supreme Court's ruling earlier that day, which for the first time affirmed that former presidents have broad immunity from prosecution.

Trump's lawyers argue that this decision could significantly impact his New York case.

In their letter to Judge Merchan, Trump's attorneys asked for a postponement of the sentencing to allow time to consider the implications of the Supreme Court's ruling. Details of the letter remain confidential, as sources who spoke with The Associated Press did so anonymously.

Trump was convicted on 34 counts of falsifying business records, related to an alleged attempt to conceal a hush money payment made shortly before the 2016 presidential election.

Judge Merchan has previously implemented a policy requiring both parties to submit one-page summaries of their arguments before filing more extensive documents. This measure aims to streamline case management and avoid being overwhelmed with excessive paperwork.
