Special Counsel Jack Smith urges the Supreme Court to deny Trump’s attempt to postpone election trial

by | Feb 14, 2024

On Wednesday, Special Counsel Jack Smith urged the Supreme Court to dismiss an emergency application filed by Donald Trump, which aimed to prolong the president's criminal trial stemming from ‘efforts to overturn the 2020 election.’

Smith submitted his response to Trump's request six days prior to the court's deadline. Trump seeks additional time to argue his case that the federal indictment should be dismissed based on presidential immunity grounds.

In his submission, Smith stated that Trump's attempt to halt an appeals court ruling, which dismissed his immunity claim, does not fulfill the essential criteria for Supreme Court intervention.

Smith proposed that if the court is inclined to entertain Trump's request, it should promptly schedule an expedited hearing and deliver a ruling as quickly as possible to facilitate the commencement of the trial.
