The Oversight Project has submitted a criminal referral to the Department of Justice seeking charges against former FBI Director Christopher Wray for allegedly misleading Congress and concealing evidence of Chinese interference in the 2020 election.
The referral accuses Wray of providing false testimony to Congress about the FBI’s knowledge of foreign election threats and about an internal memo targeting Catholics as domestic extremists.
Earlier this month, FBI Director Kash Patel revealed the bureau had located an August 2020 intelligence report detailing alarming allegations of a Chinese plot to interfere in the election on behalf of then-candidate Joe Biden. Patel stated the report, which referenced mass production of fake U.S. driver’s licenses by Chinese operatives, was never disclosed to the public and was apparently buried by senior FBI leadership for political reasons.
The Oversight Project pointed to Wray’s 2020 and 2021 Senate testimony in which he downplayed evidence of coordinated voter fraud, despite the FBI’s awareness of Chinese operations. The referral also highlights Customs and Border Protection’s July 2020 seizure of nearly 20,000 counterfeit U.S. driver’s licenses, mostly from China and Hong Kong.
The watchdog further accuses Wray of making false statements to Congress about the FBI’s now-infamous Richmond field office memo targeting traditional Catholics. While Wray testified the memo was an isolated product, Senate Judiciary Chairman Chuck Grassley recently revealed the memo had been circulated to over 1,000 FBI employees and that at least 13 additional FBI documents used similar anti-Catholic language, often drawing from Southern Poverty Law Center materials.
The referral alleges Wray’s actions constitute obstruction of Congress, corrupt conduct, and making false statements.
