House Judiciary Committee Chairman Jim Jordan (R-OH) has issued a subpoena to federal prosecutor Thomas Windom, a senior member of former Special Counsel Jack Smith’s team, compelling him to testify under oath following his refusal to answer key questions during a transcribed interview with the Committee.
The move comes after Windom declined to discuss several topics during his voluntary appearance, citing what the Committee described as an “unreasonably narrow interpretation” of the Justice Department’s authorization for testimony. Among the subjects Windom refused to address were communications with the partisan January 6th Select Committee, interactions with employees of Fulton County District Attorney Fani Willis, and internal details about his prosecutorial team.
The Committee noted that Windom’s refusals contradict the Justice Department’s stated guidance to provide “unrestricted testimony” on relevant matters. He also invoked a broad reading of Rule 6(e) of the Federal Rules of Criminal Procedure to withhold information about his work with the FBI in obtaining billing records from the Willard Hotel, his awareness of a potential FBI investigation into President Trump or his associates, and his contacts with the January 6th Committee. According to the Judiciary Committee, these justifications are not supported by existing court rulings on Rule 6(e) and do not offer a valid legal basis to avoid testimony.
