RNC Sues Nebraska Over Overseas Voting Law Ahead of Midterms

The Republican National Committee has filed a lawsuit challenging a Nebraska law that allows certain U.S. citizens living abroad who have never lived in the United States to vote based on a parent’s Nebraska residency.

 

The lawsuit, filed with two Nebraska voters, challenges a 2010 state law adopted to comply with federal overseas voting requirements. Under the statute, eligible U.S. citizens who have never resided in the United States may register and vote in Nebraska if they are not registered in another state and have a parent who is a registered Nebraska voter.

The RNC argues Nebraska’s constitution limits voting to state residents and that residency cannot be inherited. The plaintiffs are asking the court to bar election officials from issuing ballots to voters who qualify under the challenged law.
