Democrats filed a lawsuit on Monday against Georgia's election board over a new rule requiring poll workers to hand count ballots for the November election. The lawsuit, backed by the Harris-Walz campaign, argues that the system violates Georgia law and will cause delays and confusion on election night in the battleground state.
The Democratic National Committee and the Democratic Party of Georgia filed the suit, claiming the rule exceeds the election board's authority. The suit asserts that the rule violates limits meant to prevent unelected bodies from making significant legal changes without notice.
The plaintiffs are asking the court to block the rule, “to prevent potential chaos.” The rule, passed earlier this month, mandates that three poll officers at each polling site independently hand count ballots on November 5 or 6, with results matching scanner forms. Any discrepancies must be resolved by the poll manager.
Democrats have also challenged other rules passed by the same election board, with a separate trial scheduled to begin Tuesday.
