Today, America First Legal (AFL) released new documents from its lawsuit against the Federal Bureau of Investigation (FBI) and the Department of Justice (DOJ), alleging illegal concealment of federal records related to Biden-Harris government-sponsored censorship before the 2022 midterm elections.
Following the 2022 midterms, Matt Taibbi's “The Twitter Files, Part Six: Twitter, the FBI Subsidiary” disclosed that the FBI’s National Election Command Post (NECP) had directed the FBI San Francisco field office to take “additional action” on a list of accounts, including Right Side Broadcasting Network. AFL's latest findings reveal that NECP had also received similar lists from the FBI New York field office, indicating a broad, coordinated effort to monitor social media misinformation.
The documents suggest that tips about domestic accounts were routed through a complex process involving DOJ attorneys and potentially non-DOJ agencies, leading to action by the San Francisco office. NECP's involvement included requesting preservation of subscriber and content information, potentially through legal processes such as grand jury subpoenas or search warrants.
The Inspector General’s report notes that NECP, based at FBI HQ, managed information on foreign influence, cyber intrusions, and election law violations.
AFL has previously challenged the Biden-Harris Administration’s use of rarely-enforced criminal statutes against American citizens, such as Douglass Mackey, for social media posts.
