Fulton County Superior Court Judge Scott McAfee on Friday ordered prosecutors to dismiss three specific counts from the Georgia 2020 election interference case, which names President Trump and several allies as defendants.
McAfee instructed Georgia Prosecuting Attorneys’ Council Executive Director Peter Skandalakis, now overseeing the case, to drop counts 14, 15, and 27. These counts involve conspiracy, criminal attempt to file false documents, and filing false documents. Trump is specifically charged in counts 15 and 27, but 32 charges remain, including racketeering.
Challenges to the remaining charges, based on the U.S. Constitution’s Supremacy Clause, were rejected by the judge.
The case, brought by Fulton County District Attorney Fani Willis in 2023, originally charged Trump and 18 co-defendants over efforts to overturn Georgia’s 2020 election “results.” Willis and her team were removed last month due to a significant appearance of impropriety linked to her romantic relationship with former special prosecutor Nathan Wade, though a new prosecutor was appointed friday to continue the case.
