Department of War Launches Review of Misconduct Allegations Against Sen. Mark Kelly

The Department of War announced it is reviewing serious allegations against retired Navy Captain and Senator Mark Kelly following his appearance in a video encouraging U.S. troops to disobey “illegal orders.”


In accordance with the Uniform Code of Military Justice (10 U.S.C. § 688) and other applicable regulations, the department has initiated a full review of the claims to determine potential next steps.

The department emphasized that all actions will be conducted in strict compliance with military law, ensuring due process and impartiality. Officials noted that further comments will be limited to protect the integrity of the ongoing review.

The Department of War reminded the public that military retirees remain subject to the UCMJ for applicable offenses. Federal law (18 U.S.C. § 2387) also prohibits acts intended to undermine the loyalty, morale, or discipline of the armed forces. Any violations will be addressed through proper legal channels.

Servicemembers were also reminded that they are legally obligated under the UCMJ to obey lawful orders, which are presumed lawful, and that personal beliefs do not excuse disobedience.
