Appeals court rejects Peter Navarro’s attempt to evade reporting to prison next week

The DC Circuit Court of Appeals unanimously rejected ex-Donald Trump adviser Peter Navarro's attempt to evade reporting to prison next week. Navarro is required to report to a federal prison in Miami by March 19 to commence serving his four-month sentence for contempt of Congress.

In a brief, unsigned order from circuit Judges Patricia Millett, Cornelia Pillard, and Robert Wilkins, the court stated that Navarro had not adequately shown why he should stay out of prison while his appeal of the conviction is ongoing.

Navarro had contended that the federal judge's refusal to allow him to raise an executive privilege defense during his trial was erroneous. He argued that the potential for the appeals court to reverse this decision should delay his imprisonment while his case is under review.

However, the three appellate judges on Thursday dismissed all of his assertions, indicating that the court may ultimately uphold his conviction when assessing his grounds for its overturning.

Navarro received a four-month prison sentence earlier this year following his conviction in September on two counts of contempt of Congress. This stemmed from his failure to comply with a subpoena from the now defunct, highly partisan House select committee “investigating” January 6, 2021.
