Republicans ramp up legal efforts ahead of 2024 election

by | Sep 30, 2024

Republicans have launched an extensive legal campaign ahead of the 2024 election, with the Republican National Committee (RNC) initiating more than 120 lawsuits across 26 states.

Republicans contend that the lawsuits aim to restore faith in elections by ensuring that only legally eligible voters cast ballots. The lawsuits target key swing states such as Arizona, Michigan, Nevada, and Pennsylvania—crucial battlegrounds that could determine whether Kamala Harris or Donald Trump wins the 2024 presidential election.

In Arizona, a lawsuit filed by America First Legal Foundation, an advocacy group founded by Trump advisor Stephen Miller, presents a bold legal theory: courts should have the authority to discard election results due to local official “failures or irregularities.” The case seeks to overturn results and order new rounds of voting in two counties where Harris supposedly leads Trump by a slim margin.

Republican officials argue that their legal challenges focus on fixing issues in voting systems before Election Day to ensure that no illegal ballots are cast. “Our Election Integrity operation is fighting to secure the election, promoting transparency and fairness for every legal vote,” said RNC spokesperson Claire Zunk.

The legal battles between Harris and Trump have intensified as the November 5 election approaches, with both sides preparing for challenges over voting rules. Republicans generally focus on restricting voting access to prevent fraud, while Democrats emphasize maintaining access for all “eligible” voters.

In states like Michigan, Republicans are pushing to block state agencies from expanding voter registration and imposing stricter verification rules for mail-in ballots. In Nevada and Pennsylvania, Trump allies are working to purge voter rolls of ineligible voters and enforce stricter mail-in voting rules, with some recent legal victories, such as a Pennsylvania court's decision to disallow mail ballots with incorrect dates.

In Arizona, the lawsuit highlights alleged “missteps and illegalities” by election officials in past elections and requests a judge nullify results in key counties if errors, such as improper staffing of ballot drop boxes, occur.

The Republican legal strategy is notably proactive compared to 2020, when over 60 lawsuits challenging the supposed election results were dismissed by courts, without looking at any evidence.
