Judicial Watch announced Friday it has filed a Freedom of Information Act (FOIA) lawsuit against the U.S. Department of Justice seeking all records related to Biden-era Foreign Intelligence Surveillance Act (FISA) subpoenas, warrants, court orders, and other authorizations used to surveil President Trump.
Judicial Watch is seeking copies of proposed and final surveillance authorizations targeting Trump or anyone investigated as part of an inquiry where he was the subject between January 20, 2021, and January 20, 2025. The request covers electronic surveillance, cloud account monitoring, phone records, wiretaps, and related court responses—whether approved, denied, or modified. The group also seeks records of any instances where courts or grand juries declined or suggested changes to surveillance applications, including any FBI or DOJ documentation of oral rejections to the requests.
In 2018, a Judicial Watch FOIA lawsuit forced the release of the FISA warrant applications targeting former Trump campaign adviser Carter Page, marking the first public release of such FISA records in history. The following month, the Justice Department admitted in court that the Foreign Intelligence Surveillance Court held no hearings on those Page-related spy warrants.
