Election integrity suit against Michigan secretary of state filed by RNC

by | Mar 28, 2024

The RNC filed an election integrity lawsuit against Michigan Secretary of State Jocelyn Benson on Thursday. The lawsuit accuses Benson of secretly undermining the state's absentee voting safeguards.

The focal point of the lawsuit is a memorandum sent by Secretary of State Jocelyn Benson to election officials before the state's presidential primary. In the memorandum, Benson urged officials to adopt a “presumption of validity” when evaluating signatures on absentee ballot requests. The RNC argues that this directive contradicts the state constitution's requirement for signature matching.

The lawsuit aims to obtain a declaration that invalidates both the signature verification instructions and the administrative rule issued by Secretary of State Jocelyn Benson. Additionally, it seeks an order compelling Benson to retract her signature instructions.
