Texas voters on Tuesday approved Proposition 16, a constitutional amendment that adds noncitizens to the list of individuals prohibited from voting in state elections.
Proposition 16, also known as SJR 37, amends Section 1 of Article 6 of the Texas Constitution. It expands the existing restrictions—which already prevent convicted felons who do not meet legislative exceptions and individuals declared mentally incompetent by a court from voting—to explicitly include people who are not U.S. citizens.
Federal law already bars noncitizens from voting in federal elections, but Proposition 16 codifies the restriction at the state level.
