Marc Elias Moves to Block DOJ Suit Over North Carolina Voter ID Rules

Democrat elections attorney Marc Elias has moved to intervene in a lawsuit brought last week by President Trump’s Department of Justice against North Carolina, which accuses the state of violating federal election law by maintaining inaccurate voter rolls.

 

The Justice Department’s case claims North Carolina failed to comply with the Help America Vote Act (HAVA) by using a registration form that did not require essential identifying information like a driver’s license number or the last four digits of a Social Security number. The DOJ says the lawsuit is part of Trump’s Executive Order 14248, which mandates enforcement of federal election laws.

Elias is representing the North Carolina Alliance for Retired Americans, which filed to join the case through his Elias Law Group. The motion argues the DOJ hasn’t proven a single voter registered unlawfully and accuses the federal government of attempting to purge voters under the guise of compliance.

Assistant Attorney General Harmeet Dhillon defended the lawsuit, stating, “The Department of Justice will not hesitate to file suit against jurisdictions that maintain inaccurate voter registration rolls in violation of federal voting laws.”

The Department of Justice on Thursday also accused the Wisconsin Elections Commission of violating the Help America Vote Act (HAVA) by failing to provide voters with a lawful process to file complaints or receive hearings over voting concerns.
