Judicial Watch and The Daily Caller News Foundation have petitioned a Delaware court this week to reopen their case, aiming to secure the release of Joe Biden’s Senate records stored at the University of Delaware.
Special counsel Robert Hur's February report investigating Biden's handling of classified documents unveiled findings that directly challenge the university's assertion that no tax dollars were utilized in handling the requested records. The Delaware Supreme Court had previously ruled in favor of the university in July, preventing the release of the documents.
In July 2020, Judicial Watch filed a lawsuit against the university on behalf of itself and the DCNF after their request was denied. The university asserted that the records were unrelated to the use of public funds.
The documents requested by the DCNF encompassed agreements pertaining to the storage of 1,850 boxes and 415 gigabytes of records spanning Biden's Senate career from 1973 to 2009. Additionally, the request included communications between university staff and Biden's team, log sheets documenting visitors to the collection, and the collection records themselves.
Hur's report highlighted that in Spring 2011, Biden enlisted two of his former longstanding Senate staffers to review his stored boxes as part of preparations to donate his papers. Notably, these staffers were compensated by the University of Delaware to conduct the pre-gift review, as outlined in the report.
