Judge Cannon permanently blocked the Justice Department from releasing the second volume of former Special Counsel Jack Smith’s final report on President Trump’s classified documents case.
The order, sought by President Trump and former co-defendants Walt Nauta and Carlos de Oliveira, bars Attorney General Pam Bondi and any successors from releasing or sharing the volume.
Cannon wrote that Smith acted “without lawful authority” in obtaining the indictment, which ultimately ended in dismissal of all charges, and emphasized that the defendants retain the presumption of innocence. She also noted the volume contains extensive material still under a protective order and said prior special counsels released reports only after declining charges or securing convictions.
Without the ruling, the report had been set for public release Tuesday.
