A Fulton County judge has granted permission for Donald Trump and seven other defendants to appeal a ruling that denied the disqualification of Fani Willis from the Georgia racketeering case.
McAfee issued a “certificate of immediate review,” enabling the defendants to appeal his decision to the Georgia Court of Appeals before the trial commences. The appeals court will determine whether to consider the matter.
Eight defendants requested the certificate on Monday, following McAfee's partial denial of a motion to disqualify Willis due to her romantic relationship with then-special prosecutor Nathan Wade. While McAfee bizarrely ruled that Willis didn't have an actual conflict of interest, he acknowledged an appearance of a conflict, giving Willis the option to recuse herself or cut ties with Wade. Wade resigned shortly after.
The defendants argued that Wade's resignation didn't fully address the perceived impropriety, citing a lack of appellate court guidance, especially regarding Willis' recent church speech comments and potential forensic misconduct.
