Appeals Court Upholds Ruling Disqualifying Habba as New Jersey’s Top Prosecutor

by | Dec 1, 2025

A federal appeals court ruled Monday that Alina Habba is unlawfully serving as New Jersey’s top federal prosecutor.

In a unanimous order, a three-judge panel of the U.S. Court of Appeals for the 3rd Circuit affirmed a lower court’s decision to disqualify Habba, a longtime Trump loyalist who previously served as the president’s personal defense lawyer.

The administration may seek review by the full 3rd Circuit or petition the Supreme Court to take up the case.
