America First Legal has filed an amended lawsuit targeting all 15 counties in Arizona—Apache, Cochise, Coconino, Gila, Graham, Greenlee, La Paz, Maricopa, Mohave, Navajo, Pima, Pinal, Santa Cruz, Yavapai, and Yuma—alleging their failure to remove foreign citizens from their voter rolls.
On July 16, AFL had sent letters demanding that election officials in these counties take action to prevent non-citizens from voting, warning of legal action if they failed to comply. The lawsuit stems from Arizona state laws requiring monthly voter roll maintenance to ensure foreign citizens are removed. AFL had previously sued the Maricopa County Recorder in early August for non-compliance on behalf of the Strong Communities Foundation of Arizona and Yvonne Cahill, a naturalized citizen. Maricopa County moved the case to federal court, arguing that it involved federal law.
Now in federal court, AFL expanded the lawsuit to include the other 14 counties to ensure all counties comply with their statutory duties. AFL cites two federal statutes, 8 U.S.C. § 1373(c) and 8 U.S.C. § 1644, which allow state and local officials to access information about citizenship status for lawful purposes. AFL claims that by ignoring these tools, Arizona counties are undermining the integrity of the 2024 presidential election.
Stephen Miller, president of AFL, said, “We are taking emergency action to secure our elections… America First Legal will do everything in its power to fight mass illegal alien voting and foreign interference in our democracy.”
