Georgia judge Scott McAfee ruled on Friday that the racketeering case against Trump and several co-defendants can continue if either Fani Willis or Special Prosecutor Nathan Wade dismiss themselves from the case.
McAfee determined that the “appearance of impropriety” arising from Willis's romantic relationship with special prosecutor Nathan Wade necessitates either Willis and her office withdrawing from the case or only Wade, whom she had selected to lead the case, stepping down.
Additionally, the judge determined that there was no “actual conflict” resulting from the relationship, which would have necessitated Willis's disqualification. McAfee's finding stated, “Without sufficient evidence that the District Attorney acquired a personal stake in the prosecution, or that her financial arrangements had any impact on the case, the Defendants' claims of an actual conflict must be denied.”
