Fulton County Challenges FBI Warrant, Seeks Return of 2020 Election Records

by | Feb 4, 2026

Fulton County filed a motion Wednesday challenging the legality of an FBI search warrant used to seize 2020 election records from the Fulton County Election Hub last week, asking a federal court to order the return of all confiscated materials and unseal the affidavit supporting the warrant.

County officials are asking the court to narrow the scope of the warrant and ensure the records remain in Georgia so the county can conduct a full forensic accounting of the seized materials. Fulton County Commissioner Marvin Arrington Jr. told Reuters that the county’s preference is for all records to be returned. The motion also seeks the unsealing of the affidavit filed in support of the search warrant.

According to a copy of the warrant reviewed by Reuters, FBI agents were authorized to seize all physical ballots from Fulton County’s 2020 general election, tabulator tapes from every voting machine used, and voter rolls covering absentee, early, in-person, and other categories of voters.
