Fulton County District Attorney Fani Willis is set to return to the spotlight on Tuesday as she fights a subpoena compelling her to testify before a Georgia Senate committee investigating her conduct.
A Fulton County Superior Court judge will hear arguments between Willis and the State Senate Special Committee on Investigations, which seeks her testimony and documents related to her 2020 election “interference” case involving President-elect Trump and her relationship with Nathan Wade, a former special prosecutor.
Willis and her legal team argue that the broad scope of the subpoena could undermine the election interference case against Trump and his allies. She has requested a permanent injunction to block the committee’s enforcement of the subpoenas. “I will not appear to anything that is unlawful, and I have not broken the law,” Willis previously told FOX 5. “I’m sorry folks get pissed off that everybody gets treated equally.”
In September, the judge denied an emergency motion from Willis to avoid testifying, noting the time period in question had passed. Although the committee had announced plans to enforce the subpoena after Willis failed to appear, they have not yet taken formal action.
The committee is now asking the court to compel Willis to comply with the subpoena or hold her in contempt. The hearing will take place Tuesday afternoon at the Fulton County Courthouse.
