Appeals court leaves Texas immigration law blocked

by | Mar 27, 2024

In a late-night ruling on Tuesday, the United States Court of Appeals for the Fifth Circuit rejected a motion filed by the State of Texas seeking authorization for a law permitting state officers to arrest individuals who enter the country unlawfully.

The divided appeals court ruled that the law, Senate Bill 4, cannot be implemented while the state appeals a previous ruling that halted its enforcement.

Senate Bill 4 would grant Texas law enforcement the authority to arrest individuals suspected of being undocumented immigrants and empower state judges to initiate deportation proceedings. The court emphasized that immigration enforcement falls within the purview of the federal government.
