President Trump and seven other defendants involved in his Georgia racketeering case have requested a review of a judge's decision not to disqualify Fulton County District Attorney Fani Willis.
Judge Scott McAfee ruled on Friday that Willis could continue on the case against Trump as long as special prosecutor Nathan Wade resigned, despite expressing concerns about their judgment and truthfulness regarding their relationship.
The defendants petitioned McAfee on Monday to issue a certificate of immediate review, allowing them to appeal his decision, arguing that the disqualification of Nathan Wade alone is insufficient to address the perceived impropriety identified by the court.
“Should such review not occur until after any trial in this case and these decisions were ultimately reversed on appeal, such reversal would likely require the retrial of every convicted defendant without any additional showing of error or prejudice,” the motion states.
