Supreme Court sets Feb 20 Deadline for Special Counsel to Respond in Immunity Case
The U.S. Supreme Court requested a response from special counsel Jack Smith within a week, following President Donald Trump's emergency application seeking to stay the appeals court decision on his claim of absolute immunity from prosecution in Smith's election interference case.
The special counsel must file his response by the afternoon of Feb. 20. Subsequently, Trump's legal team will have an opportunity to file a reply, after which the court may act on Trump's request at its discretion.
Trump's legal team, in their submission to the Supreme Court on Monday, contended that the appellate process should proceed as it weighs significant issues and impacts the upcoming presidential election. They indicated Trump's intention to pursue en banc review by the full bench of the U.S. Court of Appeals for the District of Columbia Circuit and, eventually, seek Supreme Court review in the future.
