Rep. Matt Gaetz introduces bill to protect January 6 defendants from prosecutorial retaliation

Representative Matt Gaetz (R-FL) has proposed legislation to shield January 6 defendants from retaliation by federal prosecutors seeking to resentence them following the U.S. Supreme Court's decision in Fischer v. United States.

 

Gaetz explained that his bill aims to “provide significant relief for January 6th defendants and ensure federal prosecutors stop aggressively pursuing charges if defendants petition for resentencing.”

On June 28, the Supreme Court ruled in favor of January 6 defendant Joseph W. Fischer, concluding that the Department of Justice (DOJ) had overstepped by applying enhanced charges under the Sarbanes-Oxley financial crimes law. Previously, federal prosecutors had used an obstruction provision in the law to impose lengthy prison sentences on January 6 defendants.

Gaetz’s legislation would mandate that courts apply the current time served by defendants to any new charges brought by the Biden-Harris DOJ. This move responds to the DOJ's consideration of additional charges for some January 6 cases, as many defendants are expected to have their sentences reduced due to the Fischer decision.

The Fischer ruling affects over 300 January 6 federal prosecutions. In early July, the DOJ announced it would scale back several January 6 prosecutions impacted by the Fischer ruling. These defendants benefited from their cases being presided over by U.S. District Court Judge Carl Nichols, where the Fischer case originated.
