On Tuesday, the Manhattan district attorney’s office announced it would not oppose President Trump's request to file a motion to overturn his conviction, a decision that is expected to delay his sentencing scheduled for July 11.
Assistant District Attorney Josh Steinglass stated in a letter to Judge Juan Merchan, “Although we believe defendant's arguments to be without merit, we do not oppose his request for leave to file and his putative request to adjourn sentencing pending determination of his motion.” Prosecutors have requested two weeks to respond to the defense motion.
This development follows a landmark U.S. Supreme Court ruling on Monday, which granted President Trump some immunity from criminal prosecution for actions taken to challenge the 2020 election ‘results.’ Hours after the ruling, Trump’s attorneys submitted a letter to Judge Merchan, requesting that his New York conviction on 34 felony counts of falsifying business records be dismissed based on the Supreme Court's decision on presidential immunity.
Judge Merchan has yet to rule on Trump’s request to file the motion or make any decisions regarding the sentencing delay.
