Kansas Sues Pfizer over consumer protections violations related to COVID-19 vaccine

The state of Kansas has filed a lawsuit against pharmaceutical giant Pfizer, Inc. for alleged consumer protection violations concerning the manufacturing of its COVID-19 vaccine.

 

According to the lawsuit, Pfizer promoted its COVID-19 vaccine as safe while knowing it was linked to severe adverse events and side effects, including myocarditis, pericarditis, failed pregnancies, and fatalities. The suit contends that Pfizer concealed this critical safety information from the public.

The complaint alleges that Pfizer’s actions and representations regarding its COVID-19 vaccine violated the Kansas Consumer Protection Act, irrespective of whether any individual consumer actually received the vaccine.

The lawsuit asserts that Pfizer must be held accountable for misrepresenting the benefits of its COVID-19 vaccine while hiding and suppressing information about its safety risks, diminishing effectiveness, and inability to prevent transmission.

Filed by Republican Attorney General Kris Kobach, the suit claims that Pfizer’s misrepresentations led to record company revenues of approximately $75 billion over two years.

The lawsuit states that millions of Kansans were exposed to Pfizer’s alleged misrepresentations. As of February 7, 2024, Pfizer had administered 3,355,518 vaccine doses in Kansas, accounting for over 60% of all vaccine doses in the state, according to the lawsuit, which cites data from the Kansas Department of Health.

The lawsuit further alleges that Pfizer used various methods to conceal critical safety and effectiveness data, including confidentiality agreements, extended timelines, and the destruction of the control group in its vaccine trial.

By unblinding the original control group and allowing them to receive the vaccine, the suit claims, Pfizer, government regulators, and independent scientists cannot fully compare the vaccine’s safety and efficacy against unvaccinated individuals.

The complaint accuses Pfizer of extensive and aggressive efforts to keep its COVID-19 vaccine information hidden, conflicting with its public pledges of transparency and raising serious questions about its motives.

The lawsuit charges that Pfizer failed to disclose the limitations of its vaccine trials and had knowledge of safety issues related to the COVID-19 vaccine.

Attorney General Kobach alleges that Pfizer maintained its own adverse events database, separate from the Vaccine Adverse Event Reporting System (VAERS), which contained reports from various sources, including spontaneous reports to Pfizer, health authorities, medical literature, marketing programs, non-interventional studies, and clinical studies.

The lawsuit claims that Pfizer's adverse events database had more data than VAERS because it included both VAERS information and additional reports. Kobach asserts that Pfizer did not publicly release data from this database.
