A federal judge on Thursday dismissed President Trump's contention that the case accusing him of unlawfully retaining classified documents should be dismissed on the grounds that he regarded the material as his personal records.
Trump asserted that his retention of highly sensitive documents at his Florida estate was permissible under a U.S. law that permits former presidents to retain personal records unrelated to their official duties.
Cannon, who was appointed to the bench by Trump, had previously denied Trump's attempt to dismiss the primary charge against him, arguing it was improperly vague. Trump still has several outstanding challenges to the case, including claims of presidential immunity and allegations of selective targeting by prosecutors.
A trial is presently slated for May 20, although both sides have acknowledged that it will likely be postponed. Cannon has not yet made a ruling on the conflicting proposals for a revised schedule.
