Judge Cannon sets hearing over co-defendants’ attempt to toss indictment

The federal judge overseeing President Trump’s classified documents case has scheduled a hearing next week for his two co-defendants' attempts to dismiss their indictments.

U.S. District Judge Aileen Cannon announced on Monday that a nonevidentiary hearing would take place at 10 a.m. on April 19 regarding separate motions from Mar-a-Lago property manager Carlos De Oliveira and Trump valet Walt Nauta.

Although Trump is not involved in this hearing, it is significant as it falls just four days after jury selection begins in his separate hush-money case in Manhattan. Trump is expected to attend the trial daily when the court is in session for the coming weeks.

The April 19 hearing will focus on De Oliveira's motion to dismiss the indictment, as well as Nauta's motions to dismiss based on failure to state any offense, vagueness as applied to him, and the rule of lenity.

If Judge Cannon does not dismiss the charges against them, both defendants intend to request a bill of particulars from special counsel Jack Smith. This would provide them with essential information about the charges necessary for their defense preparation and to prevent any prejudicial surprises during the trial.

Additionally, the judge stated that she would issue an order for partially redacted filings concerning Nauta's latter two motions to dismiss.
