Florida Rep. Seeks Impeachment of Judge Who Blocked Trump’s National Guard Deployment

Florida Rep. Randy Fine is moving to impeach U.S. District Judge Charles Breyer, following Breyer’s decision to temporarily block President Trump’s deployment of the National Guard in California during the recent Los Angeles riots.

 

Fine plans to file the resolution Friday. “The goal is to get judges to do their jobs. If we’re not going to try to hold accountable the ones that aren’t, then they have no incentive to stop,” Fine told Fox News.

Citing California officials’ failure to control the unrest, Trump bypassed Democrat Governor Gavin Newsom and ordered the National Guard into the city.

Judge Breyer sided with California after Newsom’s legal challenge to the deployment, issuing a temporary injunction that halted the federalization of the state’s National Guard. In his ruling, Breyer found that Trump’s action exceeded his statutory authority and violated the Tenth Amendment, ordering control returned to the governor.

That decision was overturned last week by a three-judge panel on the Ninth Circuit Court of Appeals, which ruled that Trump acted within his constitutional powers.
