Fulton County District Attorney Fani Willis is asking a Georgia appeals court to reinstate six criminal counts against President Trump and his co-defendants in her 2020 election case. The charges were previously dismissed by a judge earlier this year.
According to a report by the Atlanta Journal-Constitution on Wednesday, Willis filed a brief urging the Georgia Court of Appeals to reverse Fulton County Judge Scott McAfee’s decision, which had dismissed charges against Trump and his associates.
In March, McAfee threw out six of the charges, citing insufficient detail in Willis’ allegations. More recently, he dismissed two additional charges, ruling that Willis and Georgia prosecutors lacked the authority to pursue claims related to the filing of false documents in federal court.
Despite these setbacks, McAfee upheld the racketeering charge against all the defendants, which remains a key element of the case.
The case has faced additional complications, including allegations that Willis had an “improper affair” with Nathan Wade, a prosecutor she brought on to assist with the Trump case. Wade later stepped down.
In June, the Georgia Court of Appeals paused the proceedings pending a decision on whether to disqualify Willis from the case, marking another major obstacle for the prosecution. The court is set to hear Trump’s argument for Willis’ disqualification on December 5, just a month after the 2024 presidential election.
Trump has pleaded not guilty to all charges.
